GENERAL TERMS AND CONDITIONS.
GLOBALGEST XXI, SL – SpainYourHome is located at Carrer del Mar, 17, 17470 - Sant Pere Pescador, Girona, SPAIN. Opening hours are from 10:00 to 13:00 and from 16:00 to 19:00 from Monday to Friday, Saturday from 10:00 to 13:00, except during holiday periods. Closed on Sundays, although we have a mobile contact phone.
PRICES AND WEBSITE: The prices published on our website are per night or per week and are divided by seasons. Although we strive to update any information about rental properties from our offices, we are not responsible for any errors that may arise, and we reserve the right to modify and update the information on our website (prices, descriptions, and photographs). Extras such as sheets, towels, cribs, etc., are not always included in the rental price. Any extra not part of the accommodation's features can be contracted if it is done before arrival.
RESERVATIONS: Reservations can be made through the website www.spainyourhome.com, by email at vacances@spainyourhome.com, by phone, in writing, or in person at our offices in Sant Pere Pescador. The client will receive a pre-reservation confirmation as proof of the agreement via email.
PAYMENT METHOD: For the reservation to be final, 50% of the total rental price must be paid within 48 hours from the pre-reservation date, either through our website or by bank transfer. (In the case of choosing a bank transfer, the receipt must be sent by email).
RENTAL PERIOD: Start, day of arrival between 4:00 p.m. and 7:00 p.m. at our offices; end: day of departure by 10:00 a.m. at the latest.
CHECK-IN AND CHECK-OUT: The check-in time in high season is between 4:00 p.m. and 7:00 p.m.; in medium and low season, there is the possibility of arriving in the morning with prior agreement with the agency, provided the accommodation is available and prepared. The check-out time will be before 10:00 a.m. If the client cannot adhere to our schedule or cannot occupy the accommodation on the scheduled day and time due to any travel difficulties or personal reasons, no refund will be made. Arrivals outside the indicated hours and without prior notice are subject to a fine of €50.
DEPOSIT: The deposit is mandatory and must be paid on the day of arrival, and it will be returned between 7 and 14 days after departure. It can be paid with a card block. Different amounts according to accommodation.
CAPACITY: The capacity of individuals will be limited according to each property. The maximum number of people will be equal to the number of sleeping places available in the property. In case of detecting more people than the indicated maximum capacity, we reserve the right to terminate the contract. GROUPS UNDER 25 YEARS OLD ARE NOT ACCEPTED.
CANCELLATIONS: In case of cancellation by the customer you will have to notify in writing our e-mail vacances@spainyourhome.com, the subscription will depend on the date of receipt of the notification:
• If cancelled more than thirty days from the arrival date, 50% of the amount paid minus 100 € management fee.
• If cancelled in less than thirty days will not be credited.
• These conditions will not apply in case of force majeure, the total amount paid minus € 100 management will be paid.
• In case the customer wants to list the departure date, no amount can be negotiated or paid.
CONSERVATION AND RESPONSIBILITIES: The client under no circumstances may have flammable, explosive, or corrosive materials. Nor may they carry out any kind of industry or immoral or unusual activities in the dwelling that may cause inconvenience to other neighbours in the urbanization where the property is located. Likewise, they must comply with any community regulations that exist in the building. The lessee is directly and exclusively responsible and exempts the property and/or the mediating company from any responsibility for damages that may occur to people or things and that are derived from installations for services and supplies of the rented seasonal house.
Although we carry out a thorough check of each accommodation before the arrival of each tenant, we understand that eventually damage may arise in the home. In such a situation, we kindly ask you to inform us immediately so that our agency can manage the necessary repairs within a reasonable time. It is important to note that, as for claims related to cleaning, we can only admit those that present themselves on the day of their arrival.
GLOBALGEST XXI, SL - SpainYourHome, EXEMPTS ITSELF FROM ALL LIABILITY IN:
- Thefts, losses, or damages that may occur to the client during their stay.
- Cuts in supplies from companies such as electricity, gas, or water.
- Breakdowns in appliances or devices. (Nevertheless, we will do everything in our power to resolve the breakdown).
- The works of the municipality or other companies outside Globalgest, as well as any smells, noises or possible discomfort caused by insects, animals or others.
LEGAL REGULATIONS: Seasonal Lease: Leases of urban properties entered for the season, whether it be summer or any other (Article 3 Law 29/1994 on Urban Leases – "LAU"). Legal Framework: Seasonal leasing, as a lease different from housing, is governed by the will of the parties, failing which, by what is provided in the LAU and, subsidiarily, by what is provided in the Civil Code. Special provisions: However, the above, certain provisions of the LAU will be mandatorily applied to Seasonal Leases, specifically those referring to the following: Scope of the law: subject to the LAU as a lease different from housing.
